After you format the system memory, you can then select the other option in the menu that lets you copy/delete/move data files. Tap on your Wii U's memory and then find the icon that says Splatoon. Press the button that says "Select items" and select Splatoon, and then press "Copy". It should copy the save data from Splatoon to your memory stick. The process will take roughly 3 minutes to complete while it copies the data. You shouldn't need more than 1GB of free space of your memory stick to do this, I don't think Splatoon save data is more than 800MB. Most USB memory sticks will have at least that much, you'll probably be just fine.
When it copies over, just turn off the Wii U and take out the memory stick and you're good to go.

As long as you don't leave before the hacker does if you do encounter it, you should be safe anyways. It's pretty rare to encounter, especially considering that only one person seems to have hacked it.
