The new number is supposed to be not equal to the old number, yet it seems that you can get 5 multiple times in a row. I don't play it often, but this happened 2 / 3 times so far to me

The sentence only means, that the second number will not be the same. When he guesses 8 and you chose higher or lower the number will never be also 8. So the number will always be higher or lower than what the guy says.
